These Terms of Service (“Terms”) constitute a legally binding agreement between you (“Client,” “you,” or “your”) and BioX Unlimited LLC d/b/a Function Bone Health (“Company,” “we,” “us,” or “our”). By accessing our website, booking an appointment, purchasing products, or using any of our services, you acknowledge that you have read, understood, and agree to be bound by these Terms in their entirety.
If you do not agree to these Terms, you must not access or use our website or services. Your continued use of our services following any modifications to these Terms constitutes your acceptance of those changes.
FUNCTION BONE HEALTH IS A WELLNESS EDUCATION AND SCREENING CENTER. WE ARE NOT A HEALTHCARE PROVIDER, MEDICAL CLINIC, MEDICAL PRACTICE, OR DIAGNOSTIC FACILITY. We do not provide medical advice, medical consultations, medical diagnosis, or medical treatment of any kind.
All services, assessments, reports, scores, consultations, recommendations, and materials provided by Function Bone Health are intended solely for educational and informational purposes. Our bone health screenings are educational tools designed to help you better understand aspects of your bone density and bone quality.
NO PROVIDER-CLIENT, PHYSICIAN-PATIENT, OR ANY SIMILAR HEALTHCARE RELATIONSHIP IS CREATED through the use of our website, services, products, or any interaction with our staff. Use of our services does not establish a doctor-patient, therapist-client, or any other professional healthcare relationship between you and Function Bone Health, its employees, contractors, or affiliates.
Our team members are wellness coaches, educators, and screening technicians — not licensed healthcare providers. Any guidance, recommendations, or information provided by our staff is educational in nature and should not be construed as medical advice.
OUR BONE HEALTH SCREENINGS ARE NOT MEDICAL DIAGNOSES. The results, scores, and reports generated from our screenings are educational tools and do not constitute a clinical diagnosis. Only a licensed healthcare provider can provide a medical diagnosis.
Function Bone Health operates under a license agreement with Screen My Bones for the use of REMS (Radiofrequency Echographic Multi Spectrometry) technology. Our use of this technology is governed by the terms and conditions of that license agreement and applicable regulations.
We strongly recommend that you share any reports, scores, or screening results with your licensed healthcare provider. Your healthcare provider is qualified to interpret these results in the context of your complete health history and medical profile. Do not disregard professional medical advice or delay seeking medical care based on any information or screening provided by Function Bone Health.
You must be at least 18 years of age to use our services, make purchases, or enter into these Terms. By using our services, you represent and warrant that you meet this age requirement.
You represent that you have the legal capacity and authority to enter into a binding agreement and to comply with these Terms.
You agree to provide accurate, current, and complete information when using our services, creating an account, booking an appointment, or making a purchase. You agree to promptly update your information to keep it accurate and current.

We reserve the right to modify, suspend, or discontinue any aspect of our services at any time, with or without notice, at our sole discretion. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of our services.
Services are subject to availability and may vary by location. We do not guarantee that any particular service will be available at all times or in all locations.
Certain features of our services may require you to create an account. When creating an account, you agree to provide accurate, current, and complete information and to update such information as necessary to maintain its accuracy.
Prior to receiving services, you may be required to sign a Client Service Agreement, intake forms, informed consent documents, and/or other documentation. These documents form part of the contractual relationship between you and Function Bone Health and are incorporated into these Terms by reference.
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account or any other breach of security. We shall not be liable for any loss arising from your failure to protect your account information.
Appointments may be booked through our website, by phone, or through other authorized channels. All bookings are subject to availability and confirmation by Function Bone Health. A security deposit may be required at the time of booking.
You will receive a booking confirmation via email and/or text message. It is your responsibility to verify the accuracy of your appointment details, including date, time, location, and selected services. Please contact us promptly if any information is incorrect.
Please arrive on time for your scheduled appointment. Late arrivals may result in a shortened session or rescheduling at our discretion. If you are unable to make your appointment, please follow our cancellation and rescheduling policy outlined in Section 9 of these Terms.
All prices for services and products are listed on our website and are subject to change without prior notice. The price in effect at the time of your booking or purchase will apply to your transaction.
We accept major credit cards, debit cards, and other payment methods as indicated at the time of checkout. All payments are processed through our third-party payment processor and are subject to their terms and conditions.
A security deposit may be required at the time of booking to reserve your appointment. The deposit will be applied toward the total cost of your selected package or service. Deposit amounts and refund eligibility are subject to our Refund & Cancellation Policy.
The remaining balance, after any deposit has been applied, is due at or before the time of your visit. Failure to pay the full balance may result in the cancellation or postponement of your services.
We may accept Health Savings Account (HSA) or Flexible Spending Account (FSA) payments where applicable. Eligibility for HSA/FSA reimbursement is determined by your plan administrator. Function Bone Health makes no representations or guarantees regarding HSA/FSA eligibility for our services or products.
Prices may or may not include applicable taxes. Any applicable sales tax, use tax, or other governmental taxes or fees will be added to your total at the time of checkout in accordance with applicable law.
Please refer to our separate Refund & Cancellation Policy for complete details regarding cancellation timelines, rescheduling procedures, refund eligibility, no-show policies, and applicable fees. The Refund & Cancellation Policy is incorporated into these Terms by reference.
Function Bone Health may offer nutritional supplements and related products through our online store. Product descriptions, images, and other information are provided for informational purposes and are believed to be accurate at the time of posting. However, we do not guarantee that product descriptions or other content are error-free, complete, or current.
THE PRODUCTS SOLD THROUGH OUR SUPPLEMENT STORE HAVE NOT BEEN EVALUATED BY THE FOOD AND DRUG ADMINISTRATION (FDA). THESE PRODUCTS ARE NOT INTENDED TO DIAGNOSE, TREAT, CURE, OR PREVENT ANY DISEASE.
You should consult with your licensed healthcare provider before starting any supplement regimen, especially if you are pregnant, nursing, taking medication, or have a medical condition. Function Bone Health is not responsible for any adverse reactions or health consequences resulting from the use of products purchased through our store.
Products sold through our supplement store are over-the-counter nutritional supplements and do not require a prescription. Our staff may provide educational information about products, but such information does not constitute medical advice or a recommendation for treatment.
All content, materials, reports, branding, trademarks, trade names, logos, graphics, images, text, software, and other intellectual property displayed on our website or provided through our services are the property of BioX Unlimited LLC d/b/a Function Bone Health, its licensors, or respective owners and are protected by applicable intellectual property laws.
We grant you a limited, non-exclusive, non-transferable, revocable license to access and use our website and services for your personal, non-commercial use, subject to these Terms. This license does not include the right to reproduce, distribute, modify, display, perform, publish, license, create derivative works from, or sell any content or materials from our website or services.

While the data contained in your individual screening results pertains to you, the format, presentation, methodology, and proprietary algorithms used to generate those results remain the intellectual property of Function Bone Health and/or its licensors. You may share your personal results with your healthcare provider or for your own personal use.

Our website and services may contain links to third-party websites, applications, or services, or may integrate with third-party platforms for payment processing, scheduling, communication, or other functionality. These third-party services are not under our control, and we are not responsible for their content, privacy practices, or terms of use.
The inclusion of any link or integration with a third-party service does not imply endorsement, sponsorship, or recommendation by Function Bone Health. Your use of any third-party service is at your own risk and is subject to that third party's terms and conditions and privacy policy. We encourage you to review the terms and privacy policies of any third-party service before providing personal information or engaging with their services.
Our bone health screenings utilize REMS (Radiofrequency Echographic Multi Spectrometry) technology, which is a radiation-free, ultrasound-based approach to assessing bone density and bone quality. This technology is provided and developed by third-party manufacturers and licensors.
While REMS technology is a scientifically validated screening tool, no technology is perfect. Results may be influenced by various factors including but not limited to operator technique, client positioning, body composition, and individual anatomical variations. Screening results are educational tools and should be interpreted by a qualified healthcare professional in the context of your overall health.
REMS screening is not a replacement for DXA (Dual-energy X-ray Absorptiometry) or any other clinical diagnostic procedure. Our screenings are educational tools and should not be used as the sole basis for any medical decision. Always consult with your licensed healthcare provider for medical evaluations and treatment decisions.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, ALL SERVICES, PRODUCTS, CONTENT, MATERIALS, REPORTS, AND INFORMATION PROVIDED BY FUNCTION BONE HEALTH ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, COMPLETENESS, RELIABILITY, OR NON-INFRINGEMENT.
WE DO NOT WARRANT THAT OUR SERVICES, WEBSITE, SCREENINGS, ASSESSMENTS, REPORTS, OR EDUCATIONAL MATERIALS WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. WE DO NOT WARRANT THAT THE RESULTS OBTAINED FROM THE USE OF OUR SERVICES WILL BE ACCURATE, RELIABLE, OR MEET YOUR EXPECTATIONS. WE MAKE NO GUARANTEES REGARDING OUTCOMES, IMPROVEMENTS, OR SPECIFIC RESULTS FROM USING OUR SERVICES OR PRODUCTS.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, BIOX UNLIMITED LLC D/B/A FUNCTION BONE HEALTH, ITS OFFICERS, DIRECTORS, MEMBERS, MANAGERS, EMPLOYEES, AGENTS, CONTRACTORS, LICENSORS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:
OUR AGGREGATE LIABILITY FOR ALL CLAIMS RELATED TO OUR SERVICES SHALL NOT EXCEED THE TOTAL AMOUNT YOU PAID TO US FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM DURING THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
You agree to indemnify, defend, and hold harmless BioX Unlimited LLC d/b/a Function Bone Health, its officers, directors, members, managers, employees, agents, contractors, licensors, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees and court costs) arising out of or in connection with:
ANY DISPUTE, CLAIM, OR CONTROVERSY ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF OUR SERVICES SHALL BE RESOLVED BY BINDING INDIVIDUAL ARBITRATION administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules then in effect. The arbitration shall be conducted in Collier County, Florida, unless otherwise mutually agreed upon by the parties. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.
YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDING SHALL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT AS A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. You waive any right to participate in a class action lawsuit or class-wide arbitration against Function Bone Health. If this class action waiver is found to be unenforceable, then the entirety of this arbitration provision shall be null and void.
Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of intellectual property rights or confidential information. Claims within the jurisdiction of small claims court may also be brought in small claims court rather than arbitration.
You may opt out of this arbitration provision by sending written notice to us at support@functionbonehealth.com within thirty (30) days of your first use of our services or the effective date of these Terms, whichever is later. Your opt-out notice must include your full name, mailing address, and a clear statement that you wish to opt out of the arbitration provision.
These Terms and any disputes arising out of or relating to these Terms or your use of our services shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law principles. To the extent that litigation is permitted under these Terms, you consent to the exclusive jurisdiction and venue of the state and federal courts located in Collier County, Florida.
Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using our services, you consent to the collection and use of your information as described in our Privacy Policy.

By using our services or providing your email address or phone number, you consent to receive electronic communications from us, including but not limited to appointment confirmations, reminders, service updates, educational materials, promotional offers, and administrative notices. You may opt out of promotional communications at any time by following the unsubscribe instructions in the communication or by contacting us directly. Opting out of promotional communications does not affect our ability to send you transactional or service-related messages.
Function Bone Health shall not be liable for any failure or delay in performing its obligations under these Terms if such failure or delay results from circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, pandemics, epidemics, government actions, war, terrorism, civil unrest, fire, flood, earthquakes, power outages, internet or telecommunications failures, equipment failures, labor disputes, or supply chain disruptions.
If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid, legal, and enforceable. If such modification is not possible, the provision shall be severed from these Terms. The invalidity, illegality, or unenforceability of any provision shall not affect the validity, legality, or enforceability of the remaining provisions, which shall continue in full force and effect.
These Terms, together with our Privacy Policy, Refund & Cancellation Policy, Disclaimer, and any Client Service Agreement or other documents executed in connection with our services, constitute the entire agreement between you and Function Bone Health regarding the subject matter hereof and supersede all prior or contemporaneous agreements, representations, warranties, and understandings, whether written, oral, or implied.
The failure of Function Bone Health to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver of any provision of these Terms will be effective only if in writing and signed by an authorized representative of Function Bone Health. No single or partial exercise of any right or remedy shall preclude any other or further exercise of such right or remedy or the exercise of any other right or remedy.
You may not assign, transfer, or delegate your rights or obligations under these Terms without our prior written consent. Function Bone Health may assign, transfer, or delegate its rights and obligations under these Terms without restriction and without notice to you. Any attempted assignment or transfer in violation of this provision shall be null and void.
We reserve the right to update, modify, or replace these Terms at any time at our sole discretion. Changes will become effective upon posting to this page with an updated “Effective” date. We may, but are not obligated to, notify you of material changes via email or a prominent notice on our website. Your continued use of our services after any changes are posted constitutes your acceptance of the revised Terms. It is your responsibility to review these Terms periodically for changes.
The following sections shall survive the termination or expiration of these Terms: Nature of Services (Section 3), Intellectual Property (Section 11), Disclaimer of Warranties (Section 15), Limitation of Liability (Section 16), Indemnification (Section 17), Dispute Resolution (Section 18), Privacy and Data Protection (Section 19), and any other provisions that by their nature are intended to survive termination.
The headings and section titles in these Terms are for convenience only and shall not affect the interpretation or construction of any provision. All references to “Sections” refer to sections of these Terms unless otherwise specified.
